Disclaimer on Consumer Review Moderation and Filtering Practices

Cogent International Manufacturing Inc. (the “Company”, “we”, “us”, or “our”) subjects all consumer-generated reviews submitted through the Energy Bird website (the “Site”) to moderation in accordance with the following principles and modalities. By submitting a review, you acknowledge and agree to the following terms and conditions governing the submission, evaluation, filtering, and publication of reviews.

We want your review to be as helpful as possible to other adult consumers of our products. Therefore, your review should be your own honest and accurate review of our products.

Please note that reviews are intended to reflect product experience. Users wishing to report product complaints, side effects or adverse experiences whilst using our products may do so via Support@energybird.com or text us at: +1 (855) 425-7003.

If your review does not meet these terms, then we may either: (i) contact you to explain why your review breaches these terms and ask you if you want to update your review to address the problem; or (ii) not post the review. 

Moderation Principles and Procedures

To ensure the integrity, relevance, and regulatory compliance of published reviews, a multitiered moderation process comprising automated and manual review mechanisms is applied.

Reviews may be submitted in English and French. The Company applies consistent moderation standards across all supported languages, namely exclusively English and French.

We use an independent third-party review platform to publish reviews on our website. Each review is independently moderated in accordance with the principles described below before it is published. The Company reserves the right to further manually review content added by consumers on the Site.

The Company is committed to publishing all genuine, relevant, and lawful consumer reviews. We do not edit reviews in a manner that alters their meaning, sentiment, or consumer intent. Redactions are limited to removal of prohibited content or personal identifiers. However, the Company reserves the right to filter, redact, reject reviews based on the following criteria:

• Authenticity and Eligibility. Reviews must be authored by individuals of legal age who have purchased the product via the Site. The Company maintains reasonable processes to verify that reviews originate from actual consumers who have purchased and used the product. In case of a doubt, we may ask you to submit a product receipt;
• Relevance to Product. Reviews must pertain directly to the product being reviewed. Content that discusses unrelated matters – including but not limited to shipping experiences, customer service interactions, or other shops or websites – may be excluded from publication;
• Sentiment Neutrality. Reviews are evaluated without regard to sentiment. Both positive and negative reviews that meet moderation standards will be published;
• Language and Safety Standards. Reviews must be suitable for general audiences. The following content is always deemed prohibited and will be filtered: (i) profanity, obscenity, or vulgar expressions; (ii) hate speech, discriminatory remarks, or defamatory statements; (iii) personal attacks or harassment. The above shall not be construed or interpreted as an exhaustive or exclusive enumeration of prohibited content, and the Company reserves the right to filter, redact, reject any review deemed inappropriate or inconsistent with these standards;
• Health Claims and Regulatory Compliance. Reviews must not contain unauthorized health claims, dosage recommendations, medical advice, or threat of legal actions against the Company. Adverse events must be reported through the specific channel and therefore may be subject to moderation if submitted via the reviews function;
• Personal Data. Reviews must not contain personal data (e.g. full names, addresses, phone numbers, or email addresses) either about you, or about other individuals. Reviewers are encouraged to use pseudonyms or nicknames.

The moderation process may take up to seventy-two (72) hours from the time you submit your review. Once your review is approved, it will appear in the reviews section of the relevant product page.

Moreover, we do not permit incentivized reviews, and we will not incentive you with prize promotions or vouchers to get a positive review.

Intellectual Property Rights

When you submit a review, ask or answer a question, or otherwise submit content to us using the review section of our website (the “Content”), you agree that:

• You are the sole author and owner of the intellectual property rights in the Content and it is your own original work;
• All ‘moral rights’ that you may have in such Content have been voluntarily waived by you;
• All Content that you post is accurate and not misleading;
• You are an adult and you have used our products;
• Use of the Content you supply does not violate these terms and will not cause injury to any person or legal entity.

You further agree that you will not submit any Content:

• That is known by you to be false, inaccurate or misleading;
• That infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
• That violates any law, statute, ordinance or regulation (including, but not limited to, those governing, consumer protection, unfair competition, anti-discrimination or false advertising);
• That is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation;
• For which you were compensated or granted any consideration by any unapproved third party;
• That includes any information that references other websites, addresses, email addresses, contact information or phone numbers;
• That contains any computer viruses, worms or other potentially damaging computer programs or files.

You agree to indemnify and hold us and our affiliates, harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown including reasonable attorneys' fees, arising out of a breach of your representations and warranties set forth above, or your violation of any law or the rights of a third party. This means that you would be responsible to us for the losses that we suffer (whether financial or otherwise) as a result of you breaking any of the promises or commitments you make in these terms.

You grant us a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute the Content and/or incorporate such Content into any form, medium or technology throughout the world without compensation to you.

All Content that you submit may be used at our sole discretion. We reserve the right to change, condense, withhold publication, remove or delete any Content on our websites that we deem to violate these terms. We do not guarantee that you will have any recourse to edit or delete any Content you have submitted. However, we may remove or refuse to post any submission to the extent authorized by law. You acknowledge that you alone are responsible for the Content. None of the Content that you submit shall be subject to any obligation of confidence by us.

The Company reserves the right to amend its moderation practices at any time, with or without prior notice, provided that such amendments shall not retroactively affect reviews already published.
